MyMob App Privacy Policy


This MyMob App Privacy Policy governs your use of our MyMob app (“the app”) on a smartphone device approved by us. This Privacy Policy forms part of our MyMob App End User Licence Agreement (EULA), available on our website at www.mymob.com. Where we post a Website Privacy Policy on our website, this MyMob App Privacy Policy should be read in conjunction with that Privacy Policy. We may update this MyMob App Privacy Policy from time to time. We will post the latest version on our website, and in any subsequent version of the app that we release. While we will use reasonable endeavours to email you if we update this Privacy Policy, it is your responsibility to ensure that you are familiar with the most recent version of this Privacy Policy each time you use the app.  Terms used in this Privacy Policy that are defined in the Privacy Act 1988 (Cth) have the meanings given to them in the Privacy Act 1988 (Cth).


What information does the MyMob App capture and how is it used?

The app collects and uses the following types of personal and sensitive information where provided by you, or other members of your “Mob”, including a child that is provided with a user name and password in order to use the app as part of your “Mob”, in the app:

  1. a. First Names;
  2. b. Last Names;
  3. c. Addresses;
  4. d. Phone numbers;
  5. e. Birth dates;
  6. f. Family status, e.g. Mum, Dad, Uncle, Aunty, etc.;
  7. g. Messages and posts;
  8. h. Diary entries; 
  9. i. Children’s vital stats, e.g. height, shoe size, shirt size, pants size;
  10. j. Children’s School information, e.g. teachers’ names, year, school address, phone, email;
  11. k. Children’s Medical information, e.g. doctors’ names, allergies, medication;
  12. l. Other information about children, including favourite things and wish lists; and
  13. m. Information about pets, e.g. names, favourite things and what is loved about them.


The personal and/or sensitive information listed above and children’s usernames and passwords may be viewed by other users of the app that have access to your “Mob” (including users of your “Mob” that become part of your “Mob” before or after you enter the above information into the app. It is important to understand that the information you add into the app now may not only be viewed by people who are in your “Mob” now – it may also be viewed by people who join your “Mob” at a future date).


Why does the app capture personal and sensitive information?

The app is designed to facilitate the sharing of information between members of your “Mob”. This is the primary purpose for which we capture and use your personal and sensitive information via the app. We collect personal and sensitive information via the app:


Minimum information that you are required to enter into the app

You are not required to enter any personal and/or sensitive information into the app, although you may still choose to do so, and we may still collect usage data in any event (unless you use a tool to block us from doing so).  Highlighted in red text in the following diagram is the minimum information that must be entered into each feature of the app in order to use the feature in the intended manner. Highlighted in white text are descriptions of optional areas in which you can also enter personal information. All of this information will be shared with your “Mob” (other than information that you enter during direct messaging sessions with another member of your “Mob” – this information will only be disclosed to those in your “Mob” in the direct messaging session). You can also use a pseudonym but if you do so or enter false personal or sensitive information about yourself into the app it may make it difficult for other members of your “Mob” to identify you or to interact with you through the app in the intended manner. 


How is the information captured?

Other than usage data which is captured automatically when you use the app, we don’t collect your personal and/or sensitive information other than where you or another user types or enters it into the app or it is otherwise disclosed to us. In addition, other than as set out in this Privacy Policy, we will not use and/or disclose any of your personal or sensitive information in a manner which might identify you.  In circumstances other than those set out in this Privacy Policy, we will not use and/or disclose any personal or sensitive information entered or uploaded into the app unless it has been de-identified and then only for statistical purposes.


Our data hosting provider

The personal and sensitive information captured by the app is stored in our database and is transmitted to and from members of your “Mob” when they use the app. The database is hosted by a third party with servers in Australia. By using the app you consent to the transfer to and from and storage of the personal and sensitive information captured by the app in the manner set out in this Privacy Policy on those servers.  


What happens if we determine we were not entitled to collect unsolicited personal or sensitive information?

If we determine that we were not entitled to collect certain unsolicited personal or sensitive information that has been captured by the app and the information is not contained in a Commonwealth record, we will, as soon as practicable, take whatever steps are reasonable to destroy the information or ensure the information is de-identified but only if it is lawful and reasonable to do so.


What happens if we no longer need the information?

If we hold personal or sensitive information about you and we no longer need the information for any purpose for which the information may be used or disclosed by us under this Privacy Policy, and the information is not contained in a Commonwealth record, and we are not required by or under an Australian law, or a court/tribunal order, to retain the information, then we will take such steps as are reasonable in the circumstances to destroy the information or to ensure the information is de-identified.


Google Analytics

As stated above, we use Google Analytics, a service provided by Google Inc. to capture and provide reports on usage data. This includes among other things your IP address and details of the type of smartphone device that you use and your approximate geographic location. This information is provided to us through your interaction with the app. Google may use usage data collected through the app to contextualize and personalize the ads displayed on its advertising network. Google may collect other usage information – such as the number of individual users of the app, the number of adult users, the number of child users and family size, how many people access each section of the app on a particular day, device-specific information (such as your hardware model, operating system version, unique device identifiers and mobile network information, including phone number). Google may associate your device identifiers or phone number with your Google Account. What are my opt out rights?

You may opt out of all personal and sensitive information collection by the app by not entering any such information into the app. However, this will make it impracticable for you to use the app unless members of your “Mob” can otherwise identify you. In addition, the app will still collect usage data unless you use a third party tool that prevents the collection of usage data from the app.  You can also opt out of personal information collection through the app by uninstalling the app. To uninstall the app you may use the standard uninstall process available as part of your device. Other users may still enter your personal information into the app.


Data Retention Policy

We do not intend to delete content captured by the app unless we are required to do so by law.  If you would like us to delete content that you have provided via the app, please contact us and we will consider your request and respond in a reasonable time. 


Direct Marketing

We will not use or disclose any personal or sensitive information entered or uploaded into the App for the purposes of direct marketing.


Security 

We take the protection of personal and sensitive information provided to us very seriously. We provide and/or use physical, electronic and procedural safeguards and use our reasonable endeavours to protect your personal and sensitive information we process and maintain from misuse, interference, loss, and from unauthorised access, modification or disclosure. For example, we limit access to this information to authorised employees and contractors who need to know that information in order to operate, develop or improve our app. 


Tips on how to protect your privacy

We provide the following tips and suggestions which may assist in protecting your privacy and that of any child that is provided with a user name and password in order to use the app as part of your “Mob”:

  1. a. Keep user names and passwords safe and secure and do not share them with anyone (encourage children to do the same);
  2. b. Educate children about the reasons privacy protection is important;
  3. c. Educate children about the potential consequences/risks involved in sharing personal and sensitive information through the app;
  4. d. Consider the long-term effects of sharing personal and sensitive information through the app (discuss the potential long-term effects of sharing personal and sensitive information through the app with children);
  5. e. Think before posting content as it may not be possible to delete such content (remind children to think before they post content for the same reason);
  6. f. Be sure you are familiar with the operation and functionality of the app before uploading or entering content into the app so that you are confident that the only people who have access to such content are those that you intended to have access;
  7. g. Encourage children in your Mob to show you or speak to you about content they intend to upload or enter into the app before they do so; and
  8. h. Encourage children to show you or speak to you about any content that makes them feel uncomfortable or upset that they view via the app.


Changes

This MyMob App Privacy Policy may be updated by us from time to time. We will notify you of any changes to our MyMob App Privacy Policy by posting the new version here. You are advised to consult this MyMob App Privacy Policy regularly for any changes. 


Your Consent

By using the app, you are consenting to the processing of your personal and sensitive information and personal and sensitive information of any child in your “Mob”, captured by the app as set forth in this MyMob App Privacy Policy. By using the app and entering and uploading personal and sensitive information into the app, you consent to our use of that personal and sensitive information for the purposes specified in this MyMob App Privacy Policy.

We take reasonable steps to ensure the information we collect from the app is up to date, accurate and complete. However, if, at any time, you discover that such information is incorrect, you may contact us by any of the above methods to have the information updated so that it is correctly recorded by us. 


The above rights of access are also available to any child who uses the app.


We are committed to complying with our legal obligations. If you think we are falling short of our obligations including by breaching our obligations under the Privacy Act 1988 (Cth) please contact us and we will investigate your complaint within a reasonable period.
